This document is a legally binding agreement (hereinafter – the Agreement / Terms) between the User and the CHARITABLE ORGANISATION CHARITABLE FUND “LIONWOOD SOFTWARE” (hereinafter – Fund), represented by the director Yurii Kaminovskyi, acting according to the Statute, Legal entity identification code 43595744, the subject of which is the User’s use of the website https://nit.school (hereinafter – Website) under the following conditions.
1.1. User is any natural person or legal entity visiting the Website;
1.2. Website means a set of data, electronic (digital) information, other objects of copyright and (or) related rights, etc., interconnected and structured within the website address https://nit.school, accessed through the Internet address;
1.3. Website use means any User`s activity on the Website, including, but not limited to: visiting and viewing the web pages of the Website, accessing any information posted on the Website, watching videos, listening to music, copying, etc. of any materials and content posted on the Website, making charitable donations using the Website, subscribing to news and automated mailing, etc.;
1.4. Content – any information, in any form, posted on the Website, including but not limited to: texts, news, videos, photos, music, images, trademarks, design, design elements, the information collation order, any sounds or sound recordings, press releases, promo videos, etc.
2. General terms
2.1. User undertakes to read the Terms carefully prior any Website use.
2.2. Using the Website, the User agrees they have read carefully the Terms and undertakes to comply with the Terms.
2.3. In case the User has not read the Terms carefully and/or does not agree to comply and/or violate the Terms, the User is not allowed to use the Website.
2.4. The Website operates “as is”, ie as the User sees it at a particular time and which is available to the User.
3.1. The Fund reserves the right to amend and update the Terms at any time without any special notice by publishing a new version of the Terms on the Website. The new version of the Terms becomes effective from its publication moment on the Website.
3.2. Continuing to use the Website, the User confirms that they have read and agreed to any changes, amendments, updates of the Terms executed by the Fund and published on the Website.
3.3. The Fund reserves the right to amend and update any and all content and information, posted on the Website at any time without any special notice to the User.
4. Intellectual property
4.1. Source code, trademarks, service marks as well as design elements, text, graphics, illustrations, videos, scripts, programs, music, sounds and other objects and their collection or any other content posted on the https://nit.school website are intellectual property objects.
4.2. All intellectual property rights or the right to use in all the intellectual property listed in paragraph 4.1. of this Terms are owned by the Fund.
4.3. Any commercial use of the intellectual property objects listed in paragraph 40.1. of this Terms is prohibited to Donors.
4.4. If technically possible (active social networks share buttons), Users may use intellectual property objects only for personal non-commercial purposes by sharing information on social networks (Facebook, Instagram, Twitter, LinkedIn) or on the Internet with mandatory active reference to the original source. Such use shall not cause financial or reputational damages to the Fund or to the Fund beneficiaries.
5. User rights
5.1. Rights of the User:
5.1.1. to use the Website within the frameworks and in the manner specified in these Terms;
5.1.3. to make a charitable donation for the purposes of Project implementation and Fund`s statutory activities implementation, having carefully read the Public Offer, which is posted by the reference. Charitable donation may be made by funds transfer to the current account of the Fund, the details of which are specified on the Website or using the PrivatBank web-interface LiqPay, by clicking on the LiqPay payment button located on the Website and following further instructions.
6. Third-party resources, services and websites
6.1. The Website may contain active references to third-party websites or other third-party resources and services. Such references are provided for the User convenience only and in no event witness the Fund`s consent or support of any information posted by such references.
6.2. The fund is not responsible for any content and/or accuracy of any information posted on third-party websites or other resources.
6.3. The Fund may use the third party services, however, the Fund does not control in any way such services and their operation.
7. Limitation of liability of the Fund
7.1. In no event shall the Fund be liable for any direct or indirect damages or any other losses, resulted from any Website or third-party websites or services, referenced on the Website, usage by the User, including, but not limited to: loss of profits, loss of opportunities, loss of goodwill, loss of data etc.
7.2. The Fund is not responsible for any errors, failures, operating delays of third-party services (payment systems etc.) that may be involved in the Terms implementation.
